Quotation and Contract key clauses

Export quotations vary significantly from the domestic ones. You need to take into account not only the best commercial practices, but also include clauses like quoted Incoterms, general conditions of sale, warranties, and arbitration and litigation schedules. Understanding those key issues in international contracts will protect your commercial interest in case any problem derives from the transaction.

Incoterms 2010

New Incoterms 2010 explained to gain control on your international trade

Incoterms are internationally accepted as the rule for interpretation of the most common trade issues: delivery, responsibilities, payment of derived costs and transfer of risk. The new revision of the Incoterms, approved by the publication 715E in the International Chamber of Commerce (ICC) will be valid from the first of January, 2011. This new revision comes after 10 years of validity of the previous revision, and takes into consideration the revised Institute Cargo Clauses (LMA/IUA) (2009). This revision will eliminate 4 Incoterms and create 2 newly incorporated Incoterms. Furthermore, it simplifies the classification to only 2 methods of transport: maritime versus any other.

We can provide specific counselling to your sales and export managers on how to propose the best Incoterms and why your customers need to understand them. Incoterms are a crucial part of your trade negotiation. They state the responsibilities and obligations of each party involved in the commercial trade. Not only that, it identifies the transfer of risk and therefore it is very important you can identify the worst posible scenario to gain more control.
